Insurance Coverage and Bad Faith
We represent underwriters at the trial and appellate levels in complex declaratory judgment actions, bad faith litigation, excess judgment cases, long-tail/environmental cases, and institutional bad faith claims. We have represented a number of insurers in class action litigation involving issues ranging from claims handling practices to sales practices.
Our lawyers work closely with our clients from the inception of the claim to resolve issues efficiently and in a way that serves our clients’ business goals. Often, our thoughtful and creative negotiation techniques can achieve a negotiated resolution. If not, we are ready to try your case, and win it.
For decades, our attorneys have served as lead trial counsel in complex coverage litigation, been appointed national coordinating counsel on long-tail coverage matters, and handled mass actions following national disasters.
The team includes a fellow in the International Society of Barristers, lawyers recognized as top litigators by Louisiana Super Lawyers, Chambers, and Best Lawyers, and a member of the Louisiana Law Institute’s Insurance and Torts Committee.
Our trial lawyers handle commercial cases involving breach of contract, fraud, non-compete and non-solicitation disputes, trade secrets, alleged unfair trade practices, defamation, professional liability and other business disputes. We’ve been on both sides. We’ve recovered damages for breach of contract, prosecuted defamation cases, and defeated attempts to enforce non-solicitation and non-competition agreements. Our practical, business-like approach to litigation gives you cost- and time-effective solutions to your legal problems, so that you can focus on your business.
Labor and Employment
We offer practical and solution-driven advice and representation on sensitive labor and employment matters. The types of matters we handle include wage/hour discrimination, harassment, and review of handbooks and employment agreements.
Our attorneys represent clients in securities disputes involving broker/dealers, registered investment advisors and others in litigated customer disputes. Our experience includes representing an asset manager in a dispute involving a state pension fund, representing a community bank in a FINRA arbitration against a national securities dealer, and representing registered investment advisors in customer disputes and transactional matters.
A successful appeal requires, first and foremost, an attorney that can analyze the issues in a trial court record and identify the appellate issues with the best chance of success. This effort often is overlooked, yet it is often the most important part of the appellate practice. Once the appellate issues are identified, exquisite research and persuasive writing is a must, followed by the best oral advocacy. Our attorneys are among the best in their generation at each of these skills.
In construction litigation, experience matters. And we have it. For more than twenty years, we have represented architects, construction companies, developers, general contractors, insurers, material suppliers, property owners, and subcontractors in a variety of disputes.
A sample of the types of cases we handle, among others, includes breach of contract, lien issues, construction defects, failure of delivery or performance, insurance and surety bond, premises liability, and structural failures.
Products Liability and Toxic Tort
We have handled numerous personal injury, wrongful death, and property damage claims arising from alleged defective products, chemical releases, and exposure. We approach these cases with ingenuity and energy. We also represent insurers in coverage matters relating to such exposures. From initial response to trial and appeal, we focus on minimizing exposure and efficiently resolving these challenging claims.
